Anti-Discrimination and Prevention of Harassment Policy
KBR India is committed to providing a non-discriminatory, non-hostile and harassment free work environment for all of its employees. The work environment should promote confidence to work, to innovate and to perform without fear of any type of harassment.
Sexual harassment at the workplace violates a woman’s sense of dignity, is against Article 14 and 15 of the Constitution of India and her right to life and to live with dignity under Article 21 of the Constitution and right to practice any profession or to carry on any occupation, trade or business, which includes a right to a safe environment free from sexual harassment. Accordingly, this Policy is formulated in accordance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (hereinafter referred as the “Act”); and The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules, 2013 (hereinafter referred as the “Rules”). This Procedure mandates that, no woman shall be subjected to Sexual Harassment at the workplace. Sexual Harassment at the workplace is a grave offence and is, therefore, punishable under civil as well as criminal laws of India.
This Procedure establishes guidelines for recognizing and dealing with sexual harassment arising at and/or out of the workplace. The complaints and investigations of sexual harassment at the workplace are specifically governed by the Internal Committee (IC) constituted under the Act.
KBR Inc., KBR India’s ultimate parent company, has a global Code of Business Conduct (COBC) that establishes a common set of ethical standards and legal principles that KBR expects every Employee to exhibit when dealing with clients, communities, and each other. KBR also expects third parties working on behalf of KBR to adhere to these same ethical standards. The COBC prohibits all forms of harassment, including sexual harassment of its Employees by other Employees, including supervisors, other members of management, third party vendor employees and clients. It is the responsibility of every Employee to cooperate in reaching this goal. Sexual Harassment is considered a serious act of misconduct under the COBC and may subject an Employee to disciplinary action, including termination. The company prohibits any form of Sexual Harassment at the workplace, whether such harassment is overt or subtle, quid pro quo (in exchange for preferential treatment) or creates a hostile environment. We encourage our Employees to report any incident that they believe to be Sexual Harassment, without the fear of retaliation. The Director of Business Conduct manages the global COBC program and reports received through the COBC Ethics Hotline.
This Procedure aims to prevent/deter the commission of acts of sexual harassment at the workplace and provides for effective prevention, prohibition, and redressal of such cases, by making a clear distinction between accepted and unaccepted social interactions, deploying an effective sexual harassment complaint resolution mechanism and providing interim relief to the complainant during the pendency of the investigation. By providing a framework for educational initiatives including gender sensitization to increase the awareness levels on recognizing and dealing with incidents of sexual harassment at the workplace
This Procedure shall extend to all employees at all office/work locations of KBR India. This includes the full workforce deployed at any KBR India premises, including third party vendor employees.
