Maternity Leave Policy

The organization endorses the right of its employees to become parents. We are also aware, that pregnancy or caring for an infant or a newly adopted child, may cause difficulties in relation to job duties. We are therefore prepared to support pregnant employees and allow new mothers, enough time to recover from childbirth and care for their child.

Applicability

This policy is applicable to all employees of 360 ONE within India.

What is Maternity Leave?

Maternity leave is a temporary absence from an employee’s position at work and applies to expectant or new mothers, who require time off for pregnancy, childbirth and childcare for adoptive and commissioning mothers.

Duration of Maternity Leave

Please note that all intervening holidays and weekends, falling during this period of maternity leave, are counted as part of leave. The duration of maternity leave varies as per the following:

Up to first two children:

For the first two children, the duration of maternity leave is of 26 weeks i.e. 182 days wherein, leave can be availed maximum 8 weeks prior to the expected date of delivery and remaining 18 weeks can be availed post childbirth.

More than two children:

A woman employee having more than two children and claiming maternity leave for the third time or more,is entitled to 12 weeks. i.e. 84 days of leave, wherein, prenatal leave can be availed maximum 6 weeks prior to the expected date of delivery and remaining 6 weeks can be availed post childbirth.

Adoptive and Commissioning mothers:

Adoptive and Commissioning mothers are entitled to 12 weeks i.e. 84 days of maternity leave calculated from the date the child is handed over. Adoptive Mother is defined as woman, who legally adopts a child below three months of age; and Commissioning mother is defined as a biological mother, who uses her egg to have a surrogate child.

Termination of pregnancy:

Women employee undergoing medical termination of pregnancy, under medical advice or in case of miscarriage, is entitled to 6 weeks i.e. 42 days of maternity leave. A duly registered attending medical practitioner should certify this and a medical certificate should be provided by the employee.

Extension of Maternity Leave

Post exhausting the eligible days of maternity leave, as prescribed under the law, women employees may request for extension of leave, in continuation to the maternity leave, up to a maximum of three months i.e.90 calendar days.

Please note that extension of leave is granted based on circumstances of each case and are subject to the accumulation of annual and/or sick leave balance, as well as a sanction from the Immediate Reporting Authority and Department Head.

Any leave in excess of the available annual leave balance and/or unapproved leave, shall be treated as leave without pay.

Resign and Re-join

In a scenario wherein, the woman employee is unable to resume work, post consuming the extension of maternity leave, the organization provides an option to resign from employment services and re-join, as a new employee, any time within one year from the date of relieving.

However, after crossing the span of one year post the relieving date, the woman employee will be treated as a fresh applicant and will require to undergo the recruitment process, all over again, as re-hiring will be on merit only.

Administrative Procedure for Maternity Leave

At any point after six months of pregnancy, the woman employee should inform the Immediate Reporting

Authority and Department Head, of such news of pregnancy.

Maternity leave may be initiated on the date chosen by the employee and supported by a medical certificate, from the attending registered medical practitioner, mentioning maternity leave start date, based on the ability to work up to that day and end date.

Woman employee should apply for maternity leave, on the HR portal, two weeks before the commencement of such leave and upload the supporting documents.

Paternity Leave Policy

Paternity Leave refers to the period of time a father takes time off from work. Childcare is the joint responsibility of both parents; thus, fathers too must devote time to ensure proper well-being of their child.

Applicability

This policy is applicable to all employees of 360 ONE Wealth within India.

Entitlements

  • Paternity Leave entitlement is of one week inclusive of weekends and/or public holidays. Leaves should be availed on continuous basis and will be sanctioned not more than twice, in the entire service period in the organization.
  • Male employees are eligible to avail paternity leave benefit in the following circumstances:
    • For less than two surviving children up to three months from the date of delivery.
    • When one legally adopts a child below the age of three months or is the legal husband of the commissioning mother from the date the child is handed over to the adopting father or legal husband of the commissioning mother, as the case may be.
  • In the event of miscarriage or medical termination of pregnancy, two days leave would be sanctioned. However, the total leave will not exceed more than eight days during the entire service period in the organization.

Paternity Leave application

Leave must be applied on the HR Portal and will be sanctioned subject to the submission of the discharge card/ hospital admission copies or adoption documents as applicable. This should be submitted as soon as one resumes work
